2. What sources and data does i.m.h. Hamburg use?
We process personal data that we receive from our customers in the course of our business activities and only process data to the extent necessary to fulfil our contractual obligations.
In addition, we process personal data that we obtain from publicly accessible sources (e.g. Internet, excerpts from the commercial register, excerpts from the press land register, etc.) or that are legitimately transmitted to us by third parties (e.g. competitor analyses, credit information, etc.).
These are relevant personal data, such as personal data (name, address and other contact data (e.g. legitimation data, ID data), order data, data from the fulfilment of our contractual obligations, information on financial data (e.g. creditworthiness data, scoring rating data, etc.), advertising and sales data, documentation data and other data comparable to the aforementioned.

3. What does i.m.h. do with this data (purpose of processing) and on what legal basis?
i.m.h. processes personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR).
a. Fulfilment of contractual obligations (Article 6(1)(b) GDPR)
The processing of personal data is carried out for the purpose of pre-contractual customer identification or to fulfil our contractual obligations. The purposes of data collection and processing are primarily for specific individual projects and only include all relevant data.
b. As part of the balancing of interests (Article 6(1)(f) GDPR), we process your data beyond the actual fulfilment of the contract in order to protect our legitimate interests and those of third parties.
Examples include
- Data exchange with credit reference agencies,
- advertising or market and opinion research, unless you have objected to the use of our customer data.
- Video surveillance to protect the rights of the home and to gather evidence,
- Building and system security measures (e.g. access control).
c. Based on your consent
When you send us personal data, we assume that you have given your consent to the processing of personal data for certain purposes (e.g. transfer of data within the company or group, evaluation of payment transaction data, marketing data) and that the processing is therefore lawful.
You may withdraw your consent at any time. This also applies to the revocation of consent declarations given to us before the GDPR came into force, i.e. before 25 May 2018. The revocation of consent does not affect the lawfulness of the data processed until the revocation.
I.e. due to legal requirements (Article 6(1)(c) GDPR) or in the public interest (Article 6(1)(e) GDPR).
We are subject to various legal provisions and thus legal obligations (e.g. to tax authorities, other official requirements (e.g. statistical offices). In this respect, we are obliged to provide the data necessary for these requirements.

4. Who gets your data?
a. Within our company, those departments and individuals have access to all information they need to fulfil our contractual and legal obligations. This also applies to service providers and agents we use. These individuals are contractually or legally bound to use this information only for the purposes described above. Any further disclosure to third parties is expressly prohibited.
b. Insofar as we are legally obliged to pass on the data provided to us to authorities or statistical offices, this will be done exclusively in accordance with the provisions of the GDPR.
c. Where i.m.h. works with financial institutions, it is necessary to pass on data to these institutions. The scope of this transfer is limited to the data necessary for the processing and in compliance with the provisions of the GDPR.
i.e. If data is transferred to third countries (countries outside the EU), this is only done to the extent that it is necessary for the execution of orders and the customer has given his consent.

5. Use of cookies
We use cookies to enable you to use certain features. Cookies are small text files that are stored on your terminal. Some of the cookies we use are deleted at the end of the browser session, i.e. when you close your browser (so-called session cookies). Other cookies remain on your device and enable us to recognise your browser on your next visit (persistent cookies). You can set your browser to notify you when cookies are set so that you can decide whether to accept them and, if so, delete them.

6. Our customers and business partners have the following data protection rights:
Every person or company concerned has the right to information under Article 15 GDPR, the right to rectification under Article 16 GDPR, the right to erasure under Article 17 GDPR, the right to restriction of processing under Article 18 GDPR, the right to object according to Art. 21 GDPR, as well as the right to data portability according to Art. 20 GDPR
 
The restrictions under §§ 34 and 35 BDSG apply to the right to information and the right to erasure.
In addition, there is a right of appeal to a competent data protection supervisory authority (Art. 77 GDPR in conjunction with Section 19 BDSG). Any consent given to the processing of personal data can be revoked at any time. This also applies to the revocation of declarations of consent that were given to fimatool consulting before the GDPR came into force. It should be noted that the revocation only applies to the future.

reCAPTCHA
To protect your inquiries via the Internet form, we use the reCAPTCHA service from Google LLC (Google). The query serves to distinguish whether the input is made by a human or abusively by automated, machine processing. The query includes sending the IP address and any other data required by Google for the reCAPTCHA service to Google. For this purpose, your input will be transmitted to Google and used there. However, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of this service. The IP address transmitted by your browser as part of reCaptcha will not be merged with other Google data. The deviating data protection regulations of the company Google apply to this data.
